Founded in 1998, LDM was created with the goal of forming a partnership of talented legal professionals who brought enthusiasm and excellence to the practice of law for the benefit of the Firm’s clients. We started with 20 attorneys collectively possessing over 150 years of experience in civil and corporate law. Today, we have 49 attorneys, even more years of experience and expanded to have over 25 different practice areas (26 to be exact)!

During the Nebraska Supreme Court’s recent March and April sessions, Attorney Cathy Trent-Vilim presented oral arguments in three separate cases. The first was an appeal defending healthcare professionals. In that appeal, Ms. Trent-Vilim argued the trial court properly granted a directed verdict in favor of the healthcare professional after the plaintiff could not establish his medical expert was sufficiently familiar with the local community where the medical services were rendered, and thus was not competent to testify as to the standard of care. The second appeal pertained to Nebraska’s inheritance taxes. Ms. Trent-Vilim argued the probate court erroneously interpreted a trust agreement to shift the burden of inheritance taxes and administrative costs to the residuary beneficiaries, instead of following the statutory default rule and apportioning the taxes in accordance with each beneficiary’s proportionate share of the trust. The third appeal also involved the defense of healthcare professionals. In that appeal, Ms. Trent-Vilim argued the trial court properly excluded untimely-disclosed expert opinions and granted summary judgment to the medical professionals. Rulings are expected in the next few months. #LDMlaw

Attorney Ryan Tunink recently presented oral argument to the Iowa Court of Appeals in an appeal defending the appointment of a trustee. The appeal is part of an ongoing intra-family dispute regarding the administration of a woman’s trust. In this specific appeal, Tunink argued that the district court correctly appointed his client as trustee in accordance with the terms of the trust agreement. Attorney Theodore Appel, Current Law Clerk Kelsey Schott, and Former Law Clerk Kendra Sparby were recently recognized by Drake University Law School for their contributions to its Moot Court Program. Ted was made as an honorary member to the Order of Barristers, a national society whose purpose is to recognize special efforts and contributions to moot court programs in American law schools, for his volunteer work in judging moot court events for Drake law school and providing advice on courtroom advocacy to students competing in those events. Kelsey was recognized as a junior member for the school’s Moot Court Board, her participation on the American Bar Association Moot Court Team in Boston, Massachusetts, and is the incoming president for the Moot Court Board. Kendra was recognized for her second place finish in the American Bar Association Client Counseling regional competition, in Omaha, Nebraska, and her participation in the American Bar Association Negotiations regional competition in Lubbock, Texas. Attorney Theodore Appel presented oral arguments to the Iowa Supreme Court in an appeal defending hospitals and healthcare professionals. In this specific appeal, Appel argued that the plaintiffs did not substantially comply with the statute because the plaintiffs’ expert signing the certificate of merit was not in a same or substantially similar field as their clients and that the expert failed to sign an affidavit. This case is a great example of how a producer should not always take the insurance company’s denial at face value. The outcome of this case was a major win for the Producer, who was able to hold the insurance company accountable and collect the payout to which he was entitled.
